Meaning
A legal order issued by a government department to direct a third party to withhold funds from a debtor’s earnings without obtaining a court decree. This procedure of administrative garnishment commonly targets wages or bank accounts to recover unpaid public obligations. It bypasses the standard judicial litigation timeline to accelerate recovery.
Withholding Protocol
Employers receive a formal directive requiring immediate deduction of specified sums from employee payroll. The recipient must compute the disposable earnings of the worker using the applicable legal limits. This action shields a portion of the income for subsistence.
Upon calculation, the withheld amount goes to the issuing authority within a designated window of time, usually within a few days of the pay date.
Priority Hierarchy
Multiple claims against the same payroll require a clear sequence of settlement. When several orders arrive, an administrative garnishment for taxes or public debts often takes precedence over private commercial claims. The timing of receipt determines the order of payees if the claims hold equal status.
Liability Exposure
Failure to execute the directive creates substantial financial exposure for the employer. The company becomes personally liable for the uncollected debt if it neglects the order. Legal expenses or penalties may also arise from non-compliance.
