Meaning
Legal instrument freezing funds in a financial institution to satisfy a debt. A bank account attachment order directs a bank to withhold specific sums from a debtor balance upon service of the writ. It prevents the withdrawal or transfer of liquid assets until a court determines the final distribution to the creditor.
This mechanism functions as a provisional remedy or an enforcement tool after a final judgment is entered.
Judicial Enforcement
Creditors secure their interests by petitioning a court for the seizure of cash assets held by third party intermediaries that hold the liquid capital of the judgment debtor. The bank account attachment order binds the financial institution immediately upon receipt. Non compliance results in direct bank liability.
Procedural Requirement
Strict service protocols ensure the validity of the freeze against competing claims or transfers. Once the bank account attachment order reaches the compliance department, the bank must file a garnishee disclosure stating the available balance. Funds are typically held in a suspense account until the court issues an order for payment.
This process requires the creditor to provide exact account details or enough identifying information to prevent the freezing of accounts belonging to individuals with similar names.
Liability Limitation
The scope of the freeze is limited to the amount specified in the writ plus accrued interest. A bank account attachment order does not usually affect funds deposited after the date of service. Processing fees apply immediately.
