Meaning
Judicial enforcement routes enable award creditors to channel foreign or domestic arbitral awards through a specialized financial court to access assets in a neighboring territory. Use of the DIFC enforcement conduit allows a party with an award to obtain an enforcement order from the DIFC courts, which is then sent directly to the onshore Dubai courts for execution against assets located in Dubai. This procedure bypasses the need for a separate onshore trial on the merits.
Jurisdictional Link
The debtor need not have any presence or assets within the DIFC for this mechanism to apply. An applicant can initiate the DIFC enforcement conduit solely to secure an order that the onshore courts must execute under mutual recognition laws.
Judicial Process
An applicant submits the arbitral award or judgment to the DIFC courts for recognition. The DIFC enforcement conduit relies on a statutory framework of mutual recognition between the DIFC courts and the Dubai courts. This streamlines the process by avoiding a re-examination of the dispute.
Asset Recovery
Once the DIFC court recognizes the award, it issues an execution order. The creditor presents this order to the onshore execution judge, who enforces it against the debtor’s bank accounts, real estate, or other physical assets. The DIFC enforcement conduit thus converts a paper victory into liquid capital.
