Judgment creditors require enforceable judicial mechanisms to compel recalcitrant debtors to satisfy outstanding monetary awards. These mechanisms, collectively known as execution remedies, allow the creditor to harness the coercive power of the state to locate, freeze, and seize the debtor’s property. They range from direct asset seizure to the redirection of income streams.
The choice of remedy depends on the nature and location of the debtor’s holdings.
Asset Seizure
Taking physical control of tangible property is a traditional method of satisfying debts. Under the suite of execution remedies, a court-appointed officer can enter the debtor’s premises to seize goods for public auction. The proceeds of the auction are then applied to the debt.
Garnishment Order
Redirection of debts owed to the debtor is another powerful enforcement tool. As part of the available execution remedies, a garnishment order forces third parties like banks or employers to pay funds directly to the creditor. This intercepts cash before the debtor can hide it.
Equitable Execution
When legal remedies are exhausted or ineffective, courts may appoint a receiver. This branch of execution remedies provides a method to manage and liquidate complex or intangible assets that cannot be reached by ordinary bailiff action. It is often used for joint-venture shares or intellectual property rights.
