Meaning
An employment agreement defines the terms and conditions under which an employee performs work in a country other than their home country for a specified duration. The foreign assignment contract modifies the primary employment relationship to account for the unique demands of international mobility. It governs the duties, compensation adjustments, and relocation arrangements during the secondment period.
The agreement terminates upon the completion of the assignment or the repatriation of the employee to their home country.
Employment Relationship
Dual contract structures or addenda to existing agreements are used to manage the transition of the employee. The foreign assignment contract usually suspends certain rights in the home country while active. This arrangement maintains the continuity of employment with the parent company.
Compensation Structure
Financial arrangements often incorporate cost-of-living adjustments, housing allowances, and tax equalization policies to ensure the employee’s purchasing power remains stable. Under a tax equalization policy, the employer calculates a hypothetical home-country tax and deducts it from the employee’s salary, while paying all actual host-country taxes on the employee’s behalf. This prevents the worker from suffering a financial disadvantage due to higher tax rates in the host country.
These packages can also include schooling allowances for dependents and relocation expenses, which are carefully structured to optimize tax efficiency. Regular reviews are conducted to adjust these allowances for currency fluctuations and local inflation.
Jurisdictional Scope
Choice of law clauses determine which national legal system governs the contract, though mandatory local labor laws of the host country often take precedence. Minimum wage laws, working hour limitations, and holiday entitlements of the host jurisdiction apply to the assignee regardless of the contractual choice. This dual legal framework requires careful alignment to avoid regulatory conflicts.
Legal counsel should verify that the contract complies with both jurisdictions before execution.
