Statutory rules in France define the ownership of inventions created by employees during their employment contract. The provision of the French IP code l611-7 divides employee inventions into distinct categories to determine whether the employer or the employee holds the intellectual property rights. It balances the employee’s contribution against the employer’s resources and direction.
The rule applies automatically to all employment relationships governed by French labor law.
Employee Compensation
Inventions made within the scope of an employee’s duties belong to the employer, but the employee is entitled to additional remuneration. Under the French IP code l611-7, collective agreements or individual employment contracts must specify the calculation method for this payment. If the employer fails to pay, the employee can bring a claim before a joint conciliation commission or the regional court.
Category Distinction
Intellectual creations fall into two main categories depending on the circumstances of their development. The first category comprises mission inventions, which are created during the performance of an employment contract that includes an inventive task. The second category comprises out-of-mission inventions, which are created outside the employee’s normal duties but using the company’s equipment or confidential data.
For this second category, the employer has the right to attribute the invention to the company, provided they pay a fair price to the employee.
Employer Prerogative
Companies must actively monitor employee disclosures to exercise their attribution rights within the statutory timeframes. When an employee files a disclosure for an out-of-mission invention, the employer must declare their intent to claim ownership within the period defined by the rules. Failure to act within this window results in the invention remaining the sole property of the employee.
This mechanism forces corporations to implement clear internal reporting procedures to prevent the loss of valuable intellectual assets.
