Meaning
Procedural relief mechanisms permit arbitral parties to obtain urgent conservatory, protective, or provisional orders before an arbitral tribunal issues its final award under institutional rules. When claimants seek lcia interim measures under Article 25 of the London Court of International Arbitration rules, tribunals assess whether the requested relief preserves status quo property rights or prevents irreparable harm. The tribunal may order security for legal costs, mandate the preservation of disputed evidence, or restrain counterparties from transferring commercial assets.
These temporary orders maintain the enforceability of the final award.
Emergency Arbitrator
Urgent applications filed prior to the formal constitution of the full arbitral panel are heard by a specially appointed emergency arbitrator under LCIA procedural rules. The LCIA Court appoints this emergency decision-maker within three business days of receiving the formal application. The emergency arbitrator possesses the authority to issue binding interim orders within fourteen days, providing rapid relief before the main tribunal takes office.
Evidentiary Burden
Applicants seeking protective measures must substantiate their claims with persuasive evidence showing urgent necessity and substantial risk of harm. The requesting party must demonstrate a reasonable possibility of success on the merits and establish that the balance of convenience favors granting relief. Tribunals routinely demand that applicants provide financial security to cover any potential damages the respondent might suffer if the interim order is later dissolved.
Enforcement Hurdle
Voluntary compliance with arbitral orders remains common, but cross-border judicial enforcement of interim measures depends entirely on local court jurisdiction. Some national legal frameworks treat interim arbitral orders as non-final decisions, refusing to execute them under the New York Convention. Consequently, parties must often bring parallel applications before domestic commercial courts at the location of the assets to obtain enforceable judicial freezing injunctions.
