Meaning
Intra-group services provided by a parent company or a centralized hub to its subsidiaries are categorized by the level of technical skill and risk they involve. Administrative support, payroll processing, and generic human resources tasks constitute low value added services under international transfer pricing frameworks. These activities are supportive in nature and do not form part of the core business operations of either the provider or the recipient.
They do not require the use of unique, valuable intangible assets or the assumption of substantial operational risk.
Pricing Method
Tax guidelines permit a simplified costing approach for these routine activities. Instead of a complex benchmarking study, the service provider applies a standard profit markup of five percent to the relevant costs. This fixed markup reduces the administrative burden of calculating a market-rate price for minor services.
Risk Assessment
Group companies must ensure the services are not classified as core operations to avoid tax adjustments. If a service contributes directly to the revenue-generating activities of the group, it cannot use the simplified five percent markup. Tax authorities regularly review service descriptions to prevent the misclassification of high-value research or marketing activities.
Documented Proof
Taxpayers must maintain documentation that demonstrates the services were actually performed. This involves keeping timesheets and service level agreements that detail the nature of the support provided. A failure to provide this evidence can lead to the tax deduction being denied.
