Meaning
Financial compensation delivered to an employee when a firm chooses to end the contract immediately rather than requiring work until the end of the warning window. The notice period pay covers the salary and benefits the worker would have earned if they had stayed on the job during the transition. It is often used to remove a departing executive from the office quickly to protect company secrets or morale.
Calculation Logic
Sums are based on the base salary and any fixed allowances defined in the employment agreement. The notice period pay does not usually include discretionary bonuses or future commission targets unless the contract specifically mentions them. Employers multiply the weekly or monthly rate by the number of units in the required notice window.
This creates a predictable exit cost that can be modeled in the restructuring budget.
Garden Leave
Companies sometimes pay the full amount while requiring the worker to stay at home and away from competitors. During this time, the notice period pay continues but the individual is forbidden from starting a new role or contacting former clients. This tactic is common in high tech manufacturing and finance where trade secrets have a short shelf life.
It provides the firm with a buffer to secure its accounts before the person enters the market.
Settlement Agreement
Parties often sign a document waiving future claims in exchange for receiving the funds as a lump sum. The notice period pay acts as the consideration that makes the waiver binding. If a worker accepts the money and then sues for unfair dismissal, the company can use the signed agreement to dismiss the case.
This finality is why many firms prefer to pay the full amount upfront.
