Meaning
Corporate metrics adjust the compensation due to an employee for a technical invention based on their level of responsibility within the firm. The position factor is a core component of the calculation under the German Employee Inventions Act. It measures how much the company resources and direction contributed to the creation of the invention versus the independent effort of the worker.
Responsibility Multiplier
High ranking managers receive a lower multiplier because their role involves generating new ideas for the business. A position factor for a laboratory assistant will be higher than that of a chief technology officer because the assistant is less expected to provide strategic innovation. This ensures that the payment matches the personal contribution of the employee.
Hierarchy Status
The scale typically ranges from one to seven depending on the degree of supervision and the professional background of the individual. A position factor of one applies to executive directors who are paid to innovate for the company. At the other end, a value of seven applies to employees whose job description has no relation to the technical field of the invention.
Calculation Method
Remuneration is found by multiplying the invention value by the participation percentage and this specific coefficient. The position factor reduces the total payout as the seniority of the inventor increases. It acknowledges that the salary of a senior leader already compensates them for the intellectual risks they take.
This creates a fair balance between the fixed wage and the variable reward for specific breakthroughs. The calculation relies on documented job descriptions to justify the assigned value during an audit. This consistency prevents arbitrary adjustments that could lead to labor disputes.
