Judicial decrees appointing an independent trustee to take possession of a debtor’s assets and manage them for the benefit of secured lenders prevent the dissipation of collateral. Upon the issuance of a receivership order, the existing management loses control of the company’s daily operations and assets. This court-supervised remedy is typically requested by senior creditors when a default occurs.
Receiver Responsibility
Appointed receivers have a duty to preserve the value of the assets under their custody. They can operate the business, collect outstanding accounts and sell property to satisfy the secured debt. Their powers are defined by the court and are subject to judicial oversight throughout the administration.
Creditor Protection
Secured parties gain a protective shield against unsecured asset grabs once the court issues the decree. The order halts all foreclosure actions and collection lawsuits by other creditors against the debtor’s estate. This suspension allows the receiver to organize a coordinated sale of the business or its components.
Corporate Consequence
Equity holders rarely recover any value from these court-mandated liquidations. The company’s assets are sold to pay off secured loans, and the legal entity is usually wound up or dissolved after the receiver finishes the distribution.
