Insolvency Clawback
Trust administrators file avoidance actions to retrieve cash or property distributed during the designated period. This recovery process is subject to statutory defenses, such as transactions made in the ordinary course of business or those involving contemporaneous exchanges for new value. When these defenses do not apply, the creditor must return the funds and file a claim as an unsecured creditor.
