Meaning
Employment law entitlement in many jurisdictions provides financial compensation to employees whose roles are eliminated due to corporate restructuring or closure. A statutory redundancy payment is calculated based on the employee’s age, weekly pay and length of service with the employer. This requirement protects workers during economic downturns or corporate reorganizations.
The employer is legally obligated to make these payments unless the business has entered insolvency.
Calculation Method
Payment formulas are set by national legislation and typically use a sliding scale that rewards longer tenure. Older employees may receive a higher multiplier of their weekly salary for each year of service. The government often sets a cap on both the weekly pay amount and the total number of years that can be counted.
This structure provides a predictable minimum payout for departing employees while limiting the financial burden on the employer.
Consultation Process
Procedural rules require employers to consult with staff or their representatives before making final redundancy decisions, especially in large-scale layoffs. The employer must explain the reasons for the redundancies, discuss ways to avoid or minimize the job losses and explore alternative employment options within the company group. If the employer fails to conduct a proper consultation within the legally mandated timeframes, employees can claim substantial compensation for unfair dismissal.
This process ensures that alternatives such as redeployment or retraining are considered before terminations occur, protecting the workforce from sudden, arbitrary dismissal.
Corporate Funding
Financial provisions for these payments must be factored into any restructuring plan or company liquidation. If a company is insolvent, the state may step in to pay the statutory redundancy from a national insurance fund. The state then seeks to recover these costs from the company’s remaining assets.
For healthy companies, the cost of these payouts can influence the scale of a restructuring program.
