Administrative agreements executed between employers and revenue authorities establish simplified tax settlement mechanisms for minor employee benefits and expenses. A PAYE settlement clearance permits an employer to make a single annual payment covering income tax and National Insurance liabilities for taxable items provided to employees. Entering this agreement prevents individual workers from facing benefit-in-kind tax assessments on small corporate gifts, staff entertainments or irregular expenses.
The scope of this arrangement stops at regular cash wages, recurring fringe benefits and substantial cash allowances.
Scope Coverage
Eligible items must meet three legal criteria, defined as minor, irregular or impracticable to allocate. Examples include corporate staff functions, relocation expenses below statutory caps and annual client gifts provided to staff. Regular salary sacrifices, company cars and standard executive bonuses are strictly excluded from coverage.
Including ineligible items voids the agreement and triggers statutory payroll audits.
Calculation Baseline
Tax computations under the agreement use a grossed-up gross taxable value calculation based on each employee’s marginal tax rate. The employer pays tax on the grossed-up value of the benefit, effectively absorbing the employee’s tax liability. National Insurance contributions are calculated at Class 1B rates on both the benefit value and the tax paid.
This grossing calculation increases the employer’s net financial outlay.
Renewal Schedule
Formal clearance agreements remain in effect for subsequent tax years until modified or cancelled by either party. Employers must submit final benefit calculations to the tax authority by specified statutory deadlines following the end of the tax year. Late submission invalidates the settlement mechanism, resulting in direct employee assessment.
