Possession Release
Execution of the waiver means the client acknowledges that their property will be stored at a different location than the head office of the firm. This move is necessary for trading in international stocks where the laws of the local country require the assets to stay within its borders.
Liability Transfer
Language in the waiver often limits the primary custodian responsibility for the mistakes or insolvency of the sub custodian. If the local bank loses the assets, the client might only have a claim against that foreign entity rather than the firm they originally hired.
