Recording Procedure
Public notification involves filing the assignment with the patent and trademark office. Although 35 usc 261 does not mandate recording for validity between parties, it creates a priority system where an unrecorded assignment is void against any subsequent purchaser for valuable consideration without notice.

Execution Protocol
Acknowledgment before a notary public or similar officer serves as prima facie evidence of the execution of an assignment. If a company fails to secure these signatures during founder onboarding, 35 usc 261 may allow subsequent bona fide purchasers to claim superior rights to the underlying invention. This requirement prevents the ambiguity that would otherwise arise from unverified claims of ownership change during the critical early stages of commercializing a new discovery.
